ARcreate is developed by simpleAR®, Inc. 

SimpleAR® is committed to protecting and respecting your privacy. In this ARcreate Privacy Policy (“Policy”), we, set out the basis on which any personal data we collect from you, an ARcreate user, through the ARcreate app, support, and service (collectively the “Service”), or that you provide to us, will be processed by us. 

The owners and contributors to ARcreate (SimpleAR®) will be referred to as “we,” “us,” or “our” in this Policy. By using ARcreate, you are deemed to be a “user” for purposes of this Policy. You and every other user (“you” or “User” as applicable) are subject to this Policy. You and each user also agree to the Terms by using the Services. In these Terms, the words “ARcreate” includes its owner(s), contributors, suppliers, licensors, and other related parties. 

We provide this privacy statement explaining our online information practices, so that you can decide whether and how to interact with ARcreate. 

We may release your information when we deem it appropriate to comply with the law, enforce our service policies, or protect ours or others’ rights, property, or safety. 

This online privacy policy applies only to information collected through our Service and not to information collected offline. 

By using ARcreate, you consent to our privacy policy. 

If we decide to change our privacy policy, we will post those changes on this page. If we have your email address, we may also send an email notifying you of any changes. 

Contact Data and Other Identifiable Information 

ARcreate collects certain user information, which may include a username and password, contact information, or any other data that you type in to ARcreate. It may also identify your IP address to help identify you. At our discretion, the service may use this data to: 

  • Personalize the user experience and/or customer service 
  • Administer a contest, promotion, survey of a feature or function pertaining to ARcreate 
  • To allow other users of the Service to contact you via the Service if they have your email address or phone number; 
  • To communicate with You regarding the Service; 
  • To administer, protect and improve our Service; 
  • To develop new products and services; 
  • To provide information to You about related products, offers and services; 
  • For any business purpose if the data is not in personally identifiable form; 
  • For any other use we describe at the point where we collect the information. 

Mobile Device Privacy 

The following applies to our service, when viewed on a mobile device: 

When accessed with a mobile device, our service may collect information automatically, such as the type of mobile device you have, device identifiers, and information about your use of ARcreate. Regardless of the device you use to access ARcreate, it will also collect information you provide, as well as information about your interaction with the service and its content. 

If location services are activated on your mobile device, our service may collect information about the location of your device. Your mobile network service providers may collect device-specific information, such as a device identifier, when you use our service or one of our mobile applications. This information collected by your mobile network service will not be associated with your user account with us, or with your personally identifiable information. 

Usernames, Passwords, and Profiles 

If prompted, Users must provide a valid email address to the Service, at which the User can receive messages. User must also update us if that email address changes. SimpleAR® reserves the right to terminate any User account if a valid email is requested but is not provided by the User. If the Service prompts or allows a User to create a username or profile, Users agree not to pick a username or provide any profile information that would impersonate someone or that is likely to cause confusion with any other person or entity. The Service reserves the right to cancel a User account or change a username or profile data at any time. Similarly, if the Service prompts or allows a User to create an avatar or upload a picture, User agrees not to use any image that impersonates some other person or entity, or that is otherwise likely to cause confusion. You are responsible for protecting your username and password for the Service, and you agree not to disclose it to any third party. You are responsible for all activity on your account, whether or not you authorized it. You agree to inform us of unauthorized use of your account. You acknowledge that if you wish to protect your interactions in the Service, it is your responsibility to use a secure encrypted connection, virtual private network, or other appropriate measures. 

Disputes 

This Policy and all matters arising from your use of the Service are governed by and will be construed according to the laws of Orange County, California, without regard to any choice of laws rules of any jurisdiction. The federal courts and state courts that have geographical jurisdiction over disputes arising at our office location in will be the only permissible venues for any and all disputes arising out of or in connection with this Policy or the Site and Service. 

Arbitration 

Notwithstanding anything that may be contrary within the “Disputes” provisions above, all matters, and all claims within a multi-claim matter, that are arbitrable, including all claims for monetary damages, shall be decided by a single arbitrator to be selected by us, who shall hold hearings in or near Orange County, California, under the rules of the American Arbitration Association. 

Information We Collect 

Our legal basis for collecting and using Your personal information described in this Policy depends on the personal information concerned. However, we normally collect personal information from you where (i) where the processing is in our legitimate interests and not overridden by your rights, (ii) We need the personal information to perform a service for you or (iii) we have Your consent to do so. 

When You request information or support, register as a user, respond to a survey or otherwise actively send us data, we may collect data such as Your name and email address. In each such instance, You will know what data we collect, because You actively submit it. 

When You use the app, we may automatically receive and record data from Your mobile device and network connection, including the device model identifier, operating system identification, network signaling, IP Address, date and time You use the Service, performance of the Service, and Your feature use in our app. 

When You install our mobile application, You will be asked to grant access to Your mobile device’s notifications, camera, microphone. Your permission for the Service to access these features is needed for the App to function properly. If You grant such permission, We may collect information about Your usage of these features. We will also ask you to grant access to Your contacts. This is simply to facilitate your use of the app. We will not collect or use any of Your contacts information unless you give us permission and only then we will use that information to enable you and your contact to use the Service. 

When You enter a Call with another user, You are transmitting voice and video via the Internet. We do not view or listen to the content of Your calls made via ARcreate, and we do not store Your audio or video once they have been delivered to their destination. 

Data Integrity 

We will take reasonable steps to ensure that personal data about You is reliable for its intended use, accurate, complete, and current. You are responsible for the accuracy of all personal data You provide to Us. As a registered user of the ARcreate app, You can review and change personal information at any time by accessing Your account on the App. Please be sure to update Your personal information promptly if it changes or becomes inaccurate. All personal data will be removed from our systems when you deregister/close your account. 

Your Choices 

Opt-Out. Marketing-related emails from us will always contain links which enable you to unsubscribe. 

Removing your Information. To discontinue Your account and have Your personal information removed, please contact us. 

If you are a resident of the European Economic Area, You may exercise the following rights available to you under applicable data protection law: 

  • If you wish to access, correct, update or request deletion of your personal data, you can do so at any time by contacting us using the contact details below. 
  • In addition, if you are a resident of the European Union, you can object to processing of your personal data, ask us to restrict processing of your personal data or request portability of your personal data. Again, you can exercise these rights by contacting us using the contact details provided below. 
  • If we have collected and process your personal data with your consent, then you can withdraw your consent at any time. This may mean your access to certain services is restricted or denied as a result. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal data conducted in reliance on lawful processing grounds other than consent. 
  • You have the right to complain to a data protection authority about our collection and use of your personal data. For more information, please contact your local data protection authority. 
  • We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws. 

Security 

Transmissions over the Internet are never 100% secure or error-free. However, We take reasonable steps to protect Your personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. It is Your responsibility to safeguard any password You use to access the Service and to change your password if You suspect that it has been compromised. You are solely responsible for any unauthorized use of the Service conducted with Your account. 

Children’s Privacy 

The Service is not intended for children under the age of 13 (16 years of age for EU residents). We do not intentionally or knowingly collect personally-identifiable information from children under this age. 

Amendments 

We reserve the right to change this Policy from time to time and in our sole discretion. We will alert You that changes have been made by indicating on the Policy the date it was last updated. When You use the Service, You are accepting the current version of this Policy as posted in the App at that time.
